Here is a snippet form the Terms of Service for Proboards...
I think their site falls under Fraud. They are fraudulently misleading the general public at the expense of another site. They could be shut down if they do not correct it...

I ever tell you I love you, Ellen? And we're not reporting them, Trevor. It leaves us open to them doing exactly the same thing. They just need to know that they have no connection to the DC2. There is no "us" that includes you, me, and all the DC2/Marvel2/DC3 family and whoever is involved over there., only "them", using our good name to offer inferior goods, as it were. Here's an excerpt from a PM I received yesterday after pointing our certain problems I had: Erhem. My reply: Just thought I'd update you to events behind the scenes. Anyway, ball's in his court. And honestly, I didn't ask anybody to go on the Marvel3. I wouldn't encourage people being exposed to that.

It's a sticky wicket, I think the term is, as we're not profiting off other peoples creations, but we are using them without permission. Does admitting that doom us? We give credit, and we use these creations for outlets for our own ideas. How you can accuse these people of committing fraud when we ourselves are using other peoples work? I think it best not to go to "the Man" as that would be a step too far, but I've asked nicely, as you can see in my previous post, and if they don't react to that... Well. They can't help but get negative attention. And like 'Chief said (Yes! I'm agreeing with the dude!) karma will deal with them in the end.

I will ask the obvious question....why Marvel3? That would be like having a DC3 when there's already a DC2. OK...not a good example so again...why? Making another site when there is already a Marvel2 seems...wrong. Or was that so obvious I shouldn't even bother ask? The only reason I started Marvel 3 is because the admin of Marvel2 has a lot of books being written and books that aren't need to be written. I just made it so other writers who are experiencing the same problem I am over at Marvel2 to come to Marvel3. I don't mean to take business away from Marvel2 but if it has to be done it has to be done. You're other question about it being same the same thing is void because there are plenty of stores and fast food restaurants that do the same thing as the other. You have McDonald, Burger King and Wendy's. Walmart and Target are very similar. And then you have three different comic book companies. Q. Why can't all of them just be under one name and have a huge universe? A. Because everybody has something different about them. And it won't always work with certain people places or things.

You have every right to start a Marvel fanfic site, but why make any reference to DC2 or Marvel2 in the first place?
There's no 'business' to take away from us. Different strokes for different folks and all. But you claim to be a spinoff from us when you are not.
What's wrong with just calling yourselves Marvel: Reborn?

I'm not trying to take away anything from you guys. I asked MarkyMark261 if it was alright for me to start Marvel3. He said go ahead. I was under the impression that there would be no problem, sicne he didn't ask me or tell me to change the name to the site. If he were I defiantly would, but he didn't so I kept it. Also I see no problem with the name. It's like telling Dc3 to change theirs. No one owns the name and quite frankly I'm not using the name to get people in.

DC3 is entirely different then DC2 in that it is based on other universes while DC2 is the main one. As far as I can tell you are doing the same exact thing as Marvel2 just without any inkling of an idea as to how to go about starting it. I don't say that to be mean, I say that because as far as I can tell you started up threads for pretty much every title and you don't have any artists and only a single writer. The problem I have with you using us as some sort of affilliate is that whereas we went about the creation of this and the sister sites with a lot of planning and know how to make them function properly, you did not. We made sure to have some sort of framework in place before we invited people to visit our site, you did not. We made sure to not steal any kind of art in any way shape or form, you did not. We went to many fan fiction and fan art sources to pull talent in and put a lot of effort into building up a community here, you have to see where I am going with this.
To say you are the equivalent of DC2 is a lie and I don't appreciate you assuming it would be cool to make that claim because it most certainly was not. I know you are not taking anything away from DC2 or Marvel2 because from what I have seen so far, you have no content to offer.
I would wish you best of luck with Marvel3 but honestly if you expect to get it up and running in even a third of the capacity that DC2 is running at, you are going to need a lot more then luck.

I have a great idea, for my site. It's just the writers haven't come yet. Trust me the site will be running smoothly once we get everyhting started. Yes I understand I have the boards up for titles I don't have writers for. That was the whole point. So people can see what titles need to be written. I have three artist and two writers to be exact. But the site like just offically opened friday everything has to start small before they become big.
But I'm tired of fighting with everyone. I'll be the bigegr person and change the name. It's nothing big considering, the name isn't whats bringing people in. I'm sorry if me having the name truly hurt any of you.

I'm sorry for acting like something of a jerk about this but it really just felt like a parasitic way to start your own site. It didn't hurt me but like an annoying mosquito buzzing around me, I was not fond of the idea of Marvel3. Your great idea seemed to be running it like DC2, in fact that is what you wrote in your What is Marvel3 statement right? It was that simple. Clearly something was lost in translation since in the last few days you have proven time and time again that it is NOT that simple.
We've been doing this for just about three years now and in that time there have been other sites that have came up using similar formats as we do so I can tell you now if you think we are going to get tired of fighting over this site you are smart for backing down.
I'll be interested to see how your site develops.

1) The site is no longer called Marvel3. I found that the name truy irritated people, which in the end gave me a bad rep. 2) It has yet to be proven that running a Fanfic site is easy. 3) The site is not like Marvel2 or DC2 for the simple fact, that this will be run more like a job than a simple message board. 4) You're maybe one of the only people that told me to change the name that wasn't a jerk. I take it to great consideration in you watching the growth of my company. And I'll show the world what I can really do.

What you are endeavoring to do isn't a company. Companies are businesses that make money. You would have to create and publish your own characters to have a company. What you are doing is a fan site. It is a labor of love and a means for creative expression. Because you felt that your vision didn't mesh well at Marvel2 and that you needed to start your own site is fine and dandy, it's not the first time it's happened here, and to be honest this site wouldn't exist if not for those exact circumstances. But to take the exact format, with a name as close to your aggrieved predecessor as possible, using copied text from that site, using stolen online fan art to dress it up, and then advertising on the main site as as essentially a replacement for Marvel2? You have to see where that would step on toes, be irresponsible, and offend the sensibilities of Charlie's friends (not goons). This site was built on hard work, creativity, and friendship. If you can come close to or surpass that with your project then best of luck to you. But I'll be honest with you, it's far from "simple" or easy.
